LDP Connect (the „App”) is provided by OSIRIS INVESTMENT S.R.L., a Romanian legal entity registered with the Trade Register Office attached to the Bucharest Tribunal under no. J2019008391401 (EUID ROONRC.J2019008391401), sole registration code (CUI) 41318860, VAT number RO41318860, with its registered office at Str. Cristian Tell nr. 19, camera 2, etaj 1, ap. 5BIS, Sector 1, București, Romania („LaDepozit”, „we” or „us”). Contact: contact@ladepozit.ro, telephone 0373 808 090.
These terms govern the use of the App and its related staff calling service. The App is intended exclusively for LaDepozit personnel and other users expressly authorized by LaDepozit; it is not offered to consumers. Your employment contract, service agreement or other agreement with LaDepozit, the Internal Regulations and applicable workplace policies remain separate and continue to apply. If a mandatory law grants you rights that these terms cannot limit, those rights prevail.
You may use the App only with an authorized account and only for work purposes approved by LaDepozit. You must keep your credentials and device secure, follow LaDepozit’s security and confidentiality policies, and promptly report a lost device, compromised account or suspected unauthorized access to privacy@ladepozit.ro and to your LaDepozit administrator. You must not share your account or use another person’s account.
You must not: use the App unlawfully or for personal purposes; access data or systems without authorization; interfere with the service or its security; misuse calling or customer information; or disclose confidential information except as authorized. You must comply with applicable third-party terms, including your mobile carrier’s data-service agreement.
We may restrict or revoke access when your authorization ends, for security reasons, or where required by law or applicable workplace policies, subject to applicable law and your relevant agreement.
Subject to these terms, LaDepozit grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for authorized purposes only, subject to the applicable app-store usage rules. You may not copy, redistribute, sell, sublicense, modify or reverse engineer the App, except to the extent applicable law or an applicable open-source license permits it. LaDepozit and its licensors retain all rights in the App and its content. The license ends automatically when your authorization to use the App ends.
For an Apple App Store download, this license permits use on Apple-branded products you own or control as allowed by Apple’s Usage Rules, including access by other accounts where Apple’s rules allow Family Sharing, volume purchasing or Legacy Contacts.
The App uses internet connectivity and third-party communications services. Calls, notifications and availability depend on connectivity, device settings, platform services and provider availability; interruptions or delays can occur. Mobile data or carrier charges may apply under your agreement with your provider.
Calls handled through the App are recorded by LaDepozit for service quality, staff training and evidence of telephone requests and agreements. External callers are informed through an automated voice message at the beginning of the call. Recordings are accessible only to authorized team members with assigned access rights and are processed as described in the LDP Connect Privacy and Security Policy. You must not make your own recordings of calls by any other means, and must not copy, download, forward or disclose recordings, except as expressly authorized by LaDepozit. If a caller states that they do not wish to be recorded, inform them that they may end the call and contact LaDepozit in writing at privacy@ladepozit.ro.
Do not rely on LDP Connect for emergency calls. Use your device’s ordinary phone service or another suitable means to contact emergency services (112).
The LDP Connect Privacy and Security Policy and LaDepozit’s general GDPR Policy (https://ladepozit.ro/politica-gdpr/) explain the personal data processed in connection with the App, the purposes, recipients, retention and data subjects’ rights. You must process information about callers, customers and contacts only for authorized purposes and in accordance with LaDepozit’s policies, the GDPR and Law no. 190/2018. Privacy questions and data subject requests must be directed to the Data Protection Officer at privacy@ladepozit.ro.
Contact contact@ladepozit.ro or 0373 808 090 for questions, complaints and support. We may update the App, add, change or remove features, or temporarily suspend the service for maintenance, security or other operational reasons.
We may revise these terms and will publish the revised version in the App or on our website. Continued use of the App after the revised terms take effect constitutes acceptance, subject to applicable law and any notice requirements under your relevant agreement.
The App is an internal work tool provided free of charge to authorized users. To the extent permitted by law, the App is provided „as is” and „as available”, and we do not guarantee uninterrupted or error-free operation or that the App will be compatible with every device.
To the extent permitted by law, LaDepozit is not liable for indirect damages or for losses caused by connectivity failures, device malfunctions or third-party services. Nothing in these terms excludes or limits liability for damage caused intentionally or through gross negligence, or any other liability that cannot be excluded or limited under Romanian law. The liability of LaDepozit employees in connection with their use of the App is governed by their employment contract and the Labour Code (Law no. 53/2003), and not by this section.
This section applies when you obtain the App through Apple’s App Store. These terms are concluded between you and LaDepozit, not Apple. LaDepozit, not Apple, is solely responsible for the App and its content. Apple has no obligation to provide any maintenance or support services for the App.
LaDepozit is responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App; any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to a warranty are LaDepozit’s responsibility, subject to applicable law and these terms.
LaDepozit, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession and use of it, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation. If a third party claims that the App or your possession and use of it infringes that third party’s intellectual property rights, LaDepozit, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.
You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a „terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You must comply with applicable third-party terms of agreement when using the App.
Questions, complaints or claims regarding the App should be sent to LaDepozit at the contact details in section 10.
Apple and its subsidiaries are third-party beneficiaries of these terms. Upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.
These terms are governed by Romanian law. Any dispute arising from or in connection with these terms will be settled amicably where possible and, failing that, by the competent courts of Bucharest, Romania, without prejudice to any mandatory jurisdiction rules, including those applicable to labour disputes.
